Parents of DUI Victim Sue Bar

The parents of a woman who was killed in a DUI crash last year are suing the bar that served alcohol to the drunk driver. The parents of Michelle Red, and 18 year old killed by drunk driver Lakedra Franklin, are suing Pompeii, the night club that served Franklin alcohol last February before she got behind the wheel and killed their daughter. Red's parents contend their daughter would still be alive today if Pompeii had cut off the obviously intoxicated Franklin.

People who serve alcohol may be liable under Texas law for damages resulting from the consumption of alcoholic beverages. Under Texas' Dram Shop statute it must be "apparent" to the defendant "at the time" the alcohol is provided, sold, or served that the person consuming the alcohol is "obviously intoxicated to the extent that he presents a clear danger to himself and others." The "intoxication of the recipient" must also be a "proximate cause of the damages suffered."
